A school’s Title IX obligations to ensure nondiscrimination on the basis of sex requires schools to provide transgender students equal to educational programs and activities even in circumstances in which other students, parents, or community members raise objections or concerns. Discrimination against transgender students based on their transgender status is a form of sex discrimination for purposes of Title IX. The Guidance states that such obligations include, but are not limited to: (1) providing a safe and nondiscriminatory environment for all students, including transgender; (2) using pronouns and names consistent with a transgender student’s gender identity irrespective of whether the student’s records have been changed accordingly; (3) allowing transgender students to access sex-segregated facilities (including bathrooms and locker rooms) and participate in sex-segregated activities consistent with their gender identity; (4) protecting students’ privacy related to their transgender status, including their birth name and sex assigned at birth and prevent the nonconsensual disclosure of same. The Guidance provides that schools may “make individual-user options available to all students who voluntarily seek additional privacy.” However, the Guidance advises that schools may not force transgender students to use individual-user options when other students are not required to do so.USDA Nondiscrimination Statement: In accordance with Federal civil rights law and U.S. Department of Agriculture (USDA) civil rights regulations and policies, the USDA, its Agencies, offices, and employees, and institutions participating in or administering USDA programs are prohibited from discriminating based on race, color, national origin, sex, disability, age, or reprisal or retaliation for prior civil rights activity in any program or activity conducted or funded by USDA. Persons with disabilities who require alternative means of communication for program information (e.g. Braille, large print, audiotape, American Sign Language, etc.), should contact the Agency (State or local) where they applied for benefits. Individuals who are deaf, hard of hearing or have speech disabilities may contact USDA through the Federal Relay Service at (800) 877-8339. Additionally, program information may be made available in languages other than English. To file a program complaint of discrimination, complete the USDA Program Discrimination Complaint Form, (AD-3027) found online at: http://www.ascr.usda.gov/complaint_filing_cust.html, and at any USDA office, or write a letter addressed to USDA and provide in the letter all of the information requested in the form.
